These Terms & Conditions ("Terms") govern every sale of products by Battery Direct, a trading name of Weglow Pty Ltd (ABN 76 668 417 874) ("we", "us", "our"), to you ("you", "customer", "buyer").
By placing an order with us — whether online, by phone, or in writing — you agree to these Terms. If you don't agree, please don't place an order.
- Goods — the batteries, solar panels, inverters and related products you have ordered from us.
- Order — your request to purchase Goods through our website, by phone or in writing.
- Trade Account — an ongoing account opened by an ABN-holding business to access trade pricing.
- Cash Customer — a one-off buyer (homeowner, builder, or business) without an active Trade Account.
- Delivery Zone — the next-day delivery region from Gympie (QLD) to Tweed Heads (NSW).
- ACL — the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- You can place an Order through our website, by emailing us, or by phone.
- An Order is an offer by you to purchase the Goods. We may accept or decline any Order at our discretion.
- A binding contract is formed only when we send you an Order Confirmation email. The mere receipt of payment does not constitute acceptance.
- We reserve the right to cancel any Order before dispatch if (a) the Goods are out of stock, (b) the price was incorrectly listed due to an obvious error, (c) we suspect fraud, or (d) we cannot verify your identity or address. If we cancel, you will receive a full refund.
- All prices on the website are listed in Australian Dollars (AUD).
- Prices are inclusive of GST unless explicitly stated otherwise. The GST component will be itemised on your tax invoice.
- Delivery fees, where applicable, are shown separately at checkout.
- We may change prices at any time without notice, but the price you pay will be the price displayed at the time we accept your Order.
- If a pricing error is obvious (for example, a battery listed at $1 instead of $5,000), we may cancel the Order and issue a full refund — see clause 3(d).
- Payment must be made in full at the time of Order, unless you have an approved Trade Account with credit terms (see Section 6).
- We accept payment via Visa, Mastercard, American Express, bank transfer (EFT), Stripe, PayPal, Afterpay (where available), and ZipPay (where available).
- For bank transfers, Goods will not be dispatched until cleared funds are received.
- You are responsible for any bank fees, currency conversion fees or third-party transaction surcharges.
- Trade Accounts are available to ABN-holding businesses subject to our approval.
- To open a Trade Account, you must provide a valid ABN, business name, business address, and contact details.
- We may, at our discretion, offer payment terms (e.g. 7-day, 14-day or 30-day) to approved Trade Account holders. Default Trade Accounts operate on a pre-payment basis.
- Late payment of an invoice may attract interest at the rate of 10% per annum, calculated daily, plus any reasonable recovery costs.
- We may suspend or close a Trade Account at any time without notice for non-payment, breach of these Terms, or any other reasonable cause.
- Trade pricing is confidential. You agree not to disclose Trade Account pricing to third parties.
7.1 Delivery Zone (Gympie to Tweed Heads)
- For Orders placed and paid for before 2:00 pm AEST on a business day, we offer next-business-day delivery anywhere within the Delivery Zone.
- Delivery times are estimates and not guaranteed. We are not liable for late delivery caused by couriers, weather, traffic or other circumstances outside our control.
- You or an authorised representative must be present to accept delivery and provide a signature. If no one is available, the courier may leave the Goods in a safe location at their discretion, or re-deliver (which may incur a fee).
7.2 Outside the Delivery Zone
- Australia-wide freight is available and quoted on a per-Order basis. Delivery times will be confirmed at checkout or via email.
- Freight outside the Delivery Zone is handled by third-party couriers (TNT, StarTrack, etc.) and standard freight terms apply.
7.3 Pickup
- Customer pickup is available from our Queensland warehouse by appointment. We will notify you when your Order is ready for collection.
- Goods must be collected within 14 days of notification. After this, storage fees may apply.
- Risk in the Goods passes to you upon delivery (or upon collection, if you are picking up).
- Title in the Goods does not pass to you until we have received payment in full. Until then, we retain ownership and you hold the Goods as bailee.
- If payment is not made, we reserve the right to enter your premises to recover the Goods.
- This clause constitutes a "Purchase Money Security Interest" (PMSI) under the Personal Property Securities Act 2009 (Cth).
- You must inspect the Goods on delivery and notify us within 48 hours of any visible damage, missing items or shortages.
- Notifications must be sent in writing to info@batterydirect.com.au with photos and your Order number.
- Claims made after 48 hours for visible damage may not be accepted. This does not affect your rights under the Australian Consumer Law (see Section 12).
10.1 Change of mind
- We do not generally accept returns for change of mind. If we agree to accept a change-of-mind return at our discretion:
- The Goods must be unused, in original packaging and in resalable condition.
- The return must be requested within 14 days of delivery.
- You are responsible for return freight costs.
- A restocking fee of up to 20% may apply.
10.2 Faulty or damaged Goods
- If your Goods are faulty, damaged in transit, or do not match the description, you are entitled to a remedy under the Australian Consumer Law (see Section 12).
- Contact us within a reasonable time at info@batterydirect.com.au with photos, your Order number and a description of the issue.
- Depending on the nature of the fault, we will arrange repair, replacement or refund as required by law.
10.3 Cancellations before dispatch
- You may cancel an Order before it is dispatched by emailing us. We will refund the full amount paid, less any payment processing fees that are non-refundable.
- Once dispatched, Orders cannot be cancelled — but the returns process above will apply.
- All batteries, inverters and solar panels are covered by the original manufacturer's warranty (typically 5–10 years for batteries and inverters, 12–25 years for solar panels — refer to each product's specification sheet).
- Manufacturer warranties are administered directly by the manufacturer. We will assist you in lodging a claim and acting as a point of contact where reasonable.
- Warranty claims may require proof of correct installation by a licensed electrician (and CEC accreditation, where relevant). Improper installation may void the manufacturer warranty.
Your rights under the ACLOur Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.
- Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that you have under the ACL or any other applicable law.
- To the extent permitted by law, our liability for breach of any non-excludable consumer guarantee is limited (at our option) to the replacement of the Goods, supply of equivalent Goods, repair of the Goods, or refund of the price paid.
- Battery Direct sells products only — we do not provide installation services.
- All batteries, inverters and solar systems must be installed by a licensed electrician with the appropriate accreditations (e.g. Clean Energy Council).
- You are solely responsible for ensuring proper installation, compliance with Australian Standards (including AS/NZS 5139 for battery installations), and obtaining any required permits or grid connection approvals.
- We accept no liability for damage, injury or loss caused by improper or unlicensed installation.
- We use reasonable care to ensure product specifications, images and descriptions on our website are accurate. Minor variations between the image and the actual product may occur.
- You are responsible for selecting Goods that are suitable for your intended application. Where in doubt, consult a licensed electrician or the manufacturer's documentation before ordering.
- We may, on request, provide general guidance on product compatibility — but this guidance is not professional engineering advice and should not be relied upon as such.
- To the maximum extent permitted by law, our total liability arising out of or in connection with any Order or these Terms is limited to the amount you paid for the relevant Goods.
- We are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profit, loss of revenue, loss of data, or downtime, arising from the use or inability to use the Goods.
- Nothing in this clause limits any liability that cannot be excluded under the ACL.
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including (without limitation) natural disasters, pandemics, government actions, strikes, supply chain disruptions, courier failures, or technology outages.
All content on the Battery Direct website (including text, images, logos, brand elements and product photography) is owned by us or our licensors and is protected by copyright. You may not copy, reproduce, modify, distribute or use any of this content for commercial purposes without our written permission.
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. The version in force at the time of your Order will apply to that Order. The latest version is always available on our website.
- These Terms are governed by the laws of the State of Queensland, Australia.
- You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
